Booking conditions
The Contract is made between Mr. Murray, and the party leader (“the Client”) who signs a booking form accepting the booking conditions on behalf of all persons named on the booking form (including those substituted or added by an agreed amendment to the booking form). A booking exists when a deposit has been paid and Mr. Murray has accepted the booking.
2. A deposit of 25% per week is required to make a definite booking. If a booking is made less than 6 weeks before departure the full amount is due at the time of the booking. The balance of the cost of the booking is due by not less than 6 weeks prior to departure. If the balance is not paid by the beginning of the 6th week before departure, Mr. Murray reserves the right to cancel the booking, retain any deposit held and invoice the Client in respect of the cancellation charges as specified in Condition 4.
3. If the Client wishes to alter the booking the Client must notify Mr. Murray
in writing and Mr. Murray will use all reasonable endeavours to assist. An alteration will be effective from the date of Mr. Murray's written confirmation of the alteration and is subject to a minimum charge of £10.00 per person. No alteration can be made to the season for which the booking is made which must remain as originally booked. Alterations made within 6 weeks of departure will be treated as a cancellation of the booking and cancellation charges as set out below will be payable by the Client but no alteration charge will be made.
4. Any cancellation of the booking must be made in writing and signed by the Client. Cancellation will become effective from the date it is received in writing by the Company at the address set out below. All cancellations are subject to a charge payable by the Client to compensate the Company for its estimated losses and expenses, which are calculated from the scale set out below. In addition to the charges shown below, it may be necessary to add under occupancy supplements to other members of the party where a cancellation is in respect of one or more members of the Client’s party but not in respect of the entire booking.

5. Mr. Murray has taken all reasonable steps to ensure that the Property managers used by the Company are reputable. However, Mr. Murray has no direct control over them and shall not be responsible for any acts or omissions by them or any persons employed by them.
6. It is always possible that circumstances over which Mr. Murray has no control may necessitate the cancellation of the booking. In such circumstances we reserve the right to cancel any booking at any time, and will be liable only to refund to the Client all monies already paid for the booking.
7. In the unlikely event that Mr. Murray is unable to provide the accommodation originally booked, he reserves the right to substitute alternative accommodation of a similar standard. Some accommodation includes access to a communal or private swimming pools, and in the unlikely event that such facilities are withdrawn from service for maintenance during the whole or part of the holiday, Mr. Murray will either arrange for the provision of alternative facilities or refund that part of the accommodation cost which was charged in respect of the use of the facility in question.
8. The accommodation booked by the Client, is reserved exclusively for the persons named on the booking form, (or those substituted or added by agreed amendment to the booking form).
9. No other persons other than those named on the booking form or substituted with Mr. Murray's written agreement may use the accommodation without his written permission.
10. Mr. Murray does not accept liability for any losses such as failure of electricity, or water supplies which arise due to circumstances beyond his control.
11. All baggage, including personal articles, are at all times and under all circumstances at the Clients risk. No responsibility will be accepted by the Company for the Client’s failure to carry passports, visas or other documents required for the journey.
12. In the unlikely event that the Client has any complaint about any aspect of the service provided by the Company, the complaint should, in the first instance, be made as soon as possible to Mr. Murray's representative in Cyprus. In the event that the matter cannot be resolved by Mr. Murray's representative to the satisfaction of the Client, the Client should make an immediate telephone call to Mr. Murray in the UK at the number sot out below and should also report the matter in writing to Mr. Murray within seven days of the Client’s return to the UK.
13. The cost of any loss or damage to the accommodation or its contents caused by the Client or any member of the Client’s party or any other person occupying the accommodation or any of the Client’s (or party members) guests or by additional persons (whether or not the written permission required by Condition 7 has been given) will be charged at Mr. Murray's discretion to the Client.
Any breakage deposit specified on the booking form must be paid at the time of making payment of the balance of the booking cost pursuant to Condition 2 and will be used by the Company in the event of any charge being made to the Client pursuant to this condition. The balance of any breakage deposit not so used shall be refunded to the Client 14 days after the Client’s return to the UK.
14. Mr. Murray has taken all reasonable steps to make sure the properties are up to a proper standard. Mr. Murray requests that all clients have insurance and accept no responsibility for incidents beyond their control.
15. Mr. Murray shall not be liable for any loss, damage or expense, and shall not be obliged to make any refund, in the event of any change or cancellation brought about by any circumstances including (without limitation) war or threat of war, strikes or other industrial disruption, natural disasters, fire, technical problems with transportation. Airport closures, quarantine, epidemics, weather conditions, government action or other events beyond the Company’s reasonable control.
15. The Contract shall be governed and construed in all respects in accordance with Scottish Law
